Buy CBD flowers legally?

Until a few years ago, cannabis was considered an intoxicating drug, which was mainly consumed by potheads and was banned worldwide. Times are changing and the worldwide ban on cannabis is softening. In many countries, marijuana has been legalized, because the hemp plant, in addition to its image as a drug plant, also enjoys the reputation of being one of the oldest medicinal plants.

Research is in full swing and in the meantime, for example, so-called medical hemp has been legalized in Germany and may be prescribed to certain patients by doctors. However, legal hurdles are high for patients to obtain a BTM prescription for medical cannabis flower or. To get medicines with cannabis active ingredients issued. Therefore, more and more people rely on a self-therapy with CBD flowers.

What is cannabidiol and what effects is CBD said to have??

CBD is an abbreviation and stands for the cannabinoid cannabidiol. It is a substance that occurs in high concentration in the flower of the female marijuana plant and is thought to have pharmacologically useful effects.

Cannabis contains body-like substances

According to current knowledge, the hemp plant Cannabis sativa contains 113 cannabinoids, the therapeutic effects of which have been scientifically studied for decades.

Cannabinoids include:

  • Tetrahydrocannabinol (THC),
  • Cannabidiol (CBD),
  • Cannabigerol (CBG),
  • Cannabinol (CBN).

In connection with scientific research, researchers discovered in the 1990s the so-called endocannabinoid system, which is part of the nervous system.

Two receptors are located there, which are significantly responsible for the control of vital body processes:

  • Cannabinoid receptor 1 (CB1),
  • Cannabinoid Receptor 2 ( CB2).

Researchers found that cannabinoids found in the cannabis plant, similar to endogenous substances (endocannabinoids), can act therapeutically as agonists on cells and activate important processes.

Researchers believe that because of this similarity, cannabinoids have high pharmacological benefits for the treatment of various diseases and conditions.

CBD and THC – a great hope for seriously ill patients

Cannabis users report de-stressing and relaxing effects when they use marijuana. Researchers are studying the substances of the cannabis plant to see if they have antipsychotic effects and to what extent cannabis medicines can be used for serious illnesses such as:

  • Cancer,
  • Aids,
  • chronic pain,
  • Multiple sclerosis (MS),
  • Epilepsy,
  • Tourette’s syndrome

as well as being medically effective for the treatment of various autoimmune diseases. Medicinal products containing active ingredients from the cannabis plant are already available and may be prescribed by a physician if indicated.

What is the legal situation: Can you legally buy CBD flowers and cannabis products??

Scientists are investigating whether active ingredients in the cannabis plant actually have healing properties on various diseases. Numerous studies indicate that this is the case, but cannabis research is still in its infancy.

Many consumers are already convinced of health properties of CBD flowers without waiting for comprehensive research results. Hopes of being able to alleviate numerous complaints and diseases with medical hemp are high.

The demand for CBD flowers and products like CBD oil is enormous. But what is the legal situation? May CBD-containing products be legally purchased?

Confusing and unclear legal situation with hemp

After decades of strict prohibition, there is currently a relaxation of hemp prohibitions worldwide. To what extent a complete legalization of marijuana has already taken place or is in the pipeline?. will be made, differs from country to country. Sometimes the legal situation depends on how much THC is contained in cannabis.

For example, in Germany, farmers are allowed to grow so-called commercial hemp under strict government supervision, as long as the THC content does not exceed the limit of 0.2 percent.

THC (tetrahydrocannabinol) is also a cannabinoid, but unlike CBD, it has a psychoactive effect and is therefore responsible for treating marijuana as an intoxicant. At the limit of 0.2 percent, the THC content is so low that no intoxicating effect occurs.

Medical cannabis prescribed by a doctor is legal when prescribed

The hemp plant Cannabis sativa still falls under government prohibitions in numerous countries, which prohibit cultivation, possession, trade and consumption. Due to the presumed positive properties, medicines with active ingredients from Cannabis sativa are now approved and prescribable in most countries.

Since the 10. March 2017, German doctors are furthermore even allowed to prescribe cannabis flowers with natural THC content if this is necessary from a therapeutic point of view. How high the active ingredient content is depends on the plant species and the cultivation method. In Germany, the THC content of medicinal hemp ranges from 1% to 22%, depending on the variety.

If medically indicated, health insurance companies may cover the cost of prescribed medical hemp. The consumption of marijuana prescribed by a doctor in public is allowed for prescription holders, but causes problems again and again, because, for example, it is not obvious for police officers during the control whether it is a legal or illegal cannabis use.

Patients are therefore advised to carry medical records with them to prove use as a medicine in case of doubt and to counteract confiscation of medicinal CBD flowers.

Low-THC CBD flowers: When are CBD products legal or illegal??

Regarding the trade and consumption of CBD flowers, there is still no agreement whether legal or illegal. While processed products of commercial hemp (z. B. hemp flower tea) with a THC value of up to 0.2 grams in Germany is not subject to the Narcotics Act (BtMG).

However, as things stand, this does not apply to unprocessed parts of the cannabis plant (z. B. Marijuana buds). According to this, CBD flowers would not be legal. However, there is an increasing tolerance to very small amounts.

Nevertheless, caution is advised. The consumer has no means to convince himself of the level of THC content. It cannot be ruled out that CBD flowers have a higher content of tetrahydrocannabinol and whoever is caught smoking hemp flowers by the police must be prepared for inconvenience.

Because during a police check, it is not easy to determine whether the hemp flower is THC-free or contains an unacceptable amount of THC. Importing legal hemp products should also be done with caution. For example, a higher THC limit applies in Switzerland than in Germany. Hemp products that are legal in Switzerland or another country might be illegal in your own country.
